1. Initial

    
1. User is an individual who creates an account on www.crowdlandia.com or any other websites we publish, Post is when "user" publishes on this or other sites owned by Crowdlandia LLC content to be displayed in our platform. As we have many proprietary systems to ensure content meets our standard of ethical and lawful content, User is responsible for materials they choose to post.


2. You are prohibited to make posts requesting illegal products, products that promoting hate, products that that are pornographic by nature, or are prohibited in your area. You are responsible to determine what is prohibited.

    
    
3. Offering any reward or incentive to benefit in programs we offer is prohibited.

        
4. Using bots with our program is strictly prohibited.


5. This Agreement can be changed at any time at the discretion of Crowdlandia LLC with or without prior notice.

        
6. No file, graphic, database, text, or other material found at the Crowdlandia LLC website can be used as evidence in any proceeding or forum whatsoever.


7. Using spam will not be tolerated and will not result in receiving a product.

        
8. We will retain any evidence to be used in a legal forum against any fraudulant parties who attempt fraud against our system.

2. Product Fulfillment

1. Participants shall be sent a physical goods with our store and via programs we offer. Products are shipped via 3rd party logistics companies.


2. In some cases we choose which products to feature using the criteria of best price for our consumers and speed of delivery. Any 3rd party logistics company we partner with is ultimately responsible for shipments including but not limited to speed of delivery, and if there was damage made during shipping.


3. No partially funded items will be shipped in the case of user Posts.


4. We provide the ability for items to be reposted by the user.


5. We reserve the right to perform product substitutions, which may be to get a better price passed back to the user, quicker shipment times, better products, and other criteria.


6. This program is available to any country where the country is an option when posting.

        
7. Items shall be shipped to the address provided by the poster, errors made by the user in their address resulting in goods delivered incorrectly are not our responsibility.

        
8. All user accounts must abide by the terms contained herein.

    

3. Term and Termination
    

1. All terms presented here are only available to individuals who are able to form legally binding contracts under applicable law, if you are not able to form into this agreement then you are not eligible to participate in our program.


2. This agreement is void where prohibited.


3. Any illegal activity conducted with our "Program" is subject to applicable laws, in addition this contract shall be considered to be in breach if any illegal activities is performed by any persons.


4. Any breach of this agreement preformed by you shall render your account void and be subject for monies donated processed back to their source at our own discretion.

4. Liability

1. IN NO EVENT SHALL WE BE LIABLE FOR ANY DAMAGES INCLUDING BUT NOT LIMITED TO ACTUAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR "Program" OR THIS AGREEMENT.


2. You agree to abide by all applicable laws in using our "Program".


3. You agree to indemnify and hold harmless our employees from any claim or demand, including attorneys fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.


4. You agree that You and (Crowdlandia LLC) are independent contractors, and that no partnership, employee-employer or franchisor-franchisee relationship is implied or created by this Agreement.


5. This Agreement shall be governed in all respects by the laws of the State of New Jersey.

5. Posting

        
1. It is free to post.

        
2. 3rd party sites we partner with have their own fee schedule. We currently work with paypal.com and 3rd party logistics.

    
3. We have set a fixed percent which includes all 3rd party fees along with our fee for the using the service

    

6. Special Cases

1. For Group causes created, such as the case for Registries. Partially funded items can have monies combined to the item of the "User" choice for items to be
   fully funded and shipped.


2. If "User" requests a return of received items it is under our sole discretion whether item can be returned. All requests made 14 days after item shows received
   by postal tracking numbers will not be accepted.


3. We retain tracking numbers to show that item has been shipped.


4. Each seperate cause shall not exceed $25,000, if so we retain the right to close the cause for reposting or request items are removed if possible so that the total
   balance of items requested are under $25,000.


5. Any remaining funds from items not funded when posting is closed shall be updated as a balance to be used by the "User".
